Judge Slams DOJ For Vindictive Case Against Immigrant #

Friday, 29 May 2026 · words

Kilmar Abrego Garcia walked out of a Nashville federal court on Friday as a symbol of the Justice Department’s terminal decay. U.S. District Judge Waverly Crenshaw dismissed a criminal immigrant-smuggling case against Abrego, ruling that the prosecution was "vindictive" retaliation. The DOJ had re-opened a 2022 traffic stop probe only after Abrego won a high-profile challenge to his wrongful deportation. Crenshaw wrote that the evidence "sadly reflects an abuse of prosecuting power."

Nashville prosecutors, reportedly acting with the knowledge of acting Attorney General Todd Blanche, secured the indictment to provide "cover" for their failure to comply with a Maryland judge's order. This use of the law as a weapon follows a pattern of 'Administrative Arbitrage' where the state monetizes or weaponizes its own failures. At the same time, the DOJ is suffering a 'brain drain,' losing a third of its immigration attorneys who refuse to man the deportation machine. When the state cannot win by the rules, it re-writes the past to punish the survivors.
